Subscriber Information:

You have to register using your phone number in order to use Call2Phone AB Services. However registration is not necessary through our website and you may contact our sales and/or support staff for registration through contact information supplied on this website.

• User Profile
Call2Phone AB stores the User Profile centrally on a server. This profie is used to contact you in the event that it is required by Call2Phone AB to render you Services.

• Feedback Information
Any and all information which is voluntarily submitted in any forms on the Website, is used for the purposes of reviewing this feedback and improving the Call2Phone AB Service and Website. Call2Phone AB reserves the right to utilize anonymous information for marketing purposes, for instance by displaying selected comments on the Website or in other communications. Call2Phone AB will not send You unwanted e-mail messages or junk mail, and Your details will not be passed to third parties for their marketing purposes without Your explicit permission. However, Call2Phone AB will use e-mail to send You messages about faults and service issues. Call2Phone AB may also use e-mail to keep You up to date with news about the Call2Phone AB Service. Further, Call2Phone AB reserves the right to use e-mail to notify You of any eventual claims related to Your use of Call2Phone AB Services, including without limitation claims of violation of third party rights.

• Subscriber Information
Call2Phone AB asks for Subscriber Information in order to verify Your identity and to provide Services. We use third party banking organizations and other providers for payment or purchase of services and if applicable may share with relevant billing provider any necessary billing data.

Please note that Your billing data is sensitive information, which can be used to find out information about Your use of Service. Please be sure to keep this information safe and do not share it with others.

• Traffic Data
In order to transmit the calls through the PSTN and to bill the calls, Call2Phone AB collects Traffic Data. Call2Phone AB will erase Traffic Data, or make Traffic Data anonymous, as soon as it is no longer needed for the purpose of the transmission of the communication or for billing purposes, unless applicable law permit otherwise.

 

4. To whom does Call2Phone AB transfer Your personal information?     
Except as provided below, Call2Phone AB shall not sell, rent, trade or otherwise transfer any Personal and/or Traffic Data or Communications Content to any third party without Your explicit permission, unless it is obliged to do so under applicable laws or by order of the competent authorities.

In order to provide You with the Call2Phone AB Services or other services offered through partners which You have requested, Call2Phone AB may sometimes, if necessary, share Your Personal and Traffic Data with carriers, partner service providers and/or agents, for example the PSTN-VoIP gateway provider and/or the third party banking organization or other providers of payment services. Call2Phone AB will always require these third parties to take appropriate organizational and technical measures to protect Your Personal Data and Traffic Data and to observe the relevant legislation. Please be informed that, notwithstanding the abovementioned, in the event of a designated competent authority requesting Call2Phone AB or Call2Phone AB’s local partner responsible towards such authority, to retain and provide Personal and/or Traffic Data, or to install wiretapping equipment in order to intercept communications, Call2Phone AB and/or its local partner will provide all necessary assistance and information to fulfill this request.

Information collected on the Website may be stored and processed in any country in which Call2Phone AB and its affiliates maintain facilities, including outside of the Sweden . In this regard, or for purposes of sharing or disclosing data in accordance with this article 4, Call2Phone AB reserves the right to transfer information outside of Your country. By using Call2Phone AB Service You consent to any such transfer of information outside of Your country. As Call2Phone AB continues to develop its business, Call2Phone AB might sell or buy subsidiaries or business units. In such transactions as well as in the event Call2Phone AB or substantially all of its assets are acquired by a third party, personal information of Call2Phone AB users will generally be one of the transferred business assets. We reserve the right to include Your personal information, collected as an asset, in any such transfer to a third party.

Call2Phone AB reserves the right to modify the provisions of this Privacy Statement if deemed necessary. The revised Privacy Statement shall become effective within thirty (30) days of such publishing, unless You expressly accept the revised statement earlier by clicking on the accept button. Call2Phone AB will retain Your information for as long as is necessary to: (1) perform Call2Phone AB Services; (2) invoice to You Your use of Services and to maintain records until invoicing for Services cannot be lawfully challenged and legal proceedings may no longer be pursued; (3) carry out Call2Phone AB marketing activities; (4) comply with applicable legislation, regulatory requests and relevant orders from competent courts; (5) enforce our Terms of Service; or (6) fulfill any of the other purposes detailed in this Privacy Statement.

If so, you will be asked to accept the provider’s own terms of services, which will supersede the Call2Phone AB Terms of Service in case of conflict.
If prohibited by the law of your country to use our products because you’re under the age limit or just because our products are nor allowed in your country, please don’t use them.
Before using any of the Call2Phone AB services, please make sure you have read and agreed to the Privacy Policy.

Expectation from Call2Phone AB:
What should be or should not be expected from Call2Phone AB while using it. Call2Phone AB will have no liability whatsoever for any of the following:

Quality:
Call2Phone AB will try best to provide the Call2Phone AB products as less disruption as possible. However expectation to provide services without disruptions, delay or other imperfections at every time is not guaranteed. Call2Phone AB products will be transmitted through public Internet lines and the public switched telephone network ("PSTN"), there may be power outages or Internet service disruption and you may experience some disruptions in the Call2Phone AB products, e.g. packet loss and delay which will interfere with the quality of your communication.

Improvement and maintenance of technology:
Technical features can be changed in order to keep pace with the latest demands and technological developments or to comply with any regulations. Call2Phone AB may also have to repair, improve, and/or upgrade the Call2Phone AB products and this may require us to restrict, limit, suspend, interfere and/or interrupt the Call2Phone AB products.

Communications content:
Call2Phone AB does not control, or have any knowledge of the content of any communication(s) spread by the use of the Call2Phone AB products/services. The content of the communication is entirely the responsibility of the person from whom such content originated. You, therefore, may be exposed to content that is offensive, illegal, harmful to minors, indecent or otherwise objectionable.

Expectation for user
You will be required to provide Call2Phone AB in good time with any data or information necessary for a proper provision of the Call2Phone AB calling services.
It is agreed the Call2Phone AB services shall not be resold to any third party.
It is agreed that user will indemnify Call2Phone AB and its affiliates against any third-party claims incurred by Call2Phone AB arising out of or relating to your violation of these Terms of Service, applicable law or rights of any third parties related to the use of our products.

Payment Instructions

Credit balance:
To use payable Call2Phone AB products you need a positive and sufficient credit balance. Deposit sufficient credit in your account through your debit or credit card, Moneybookers, promotional voucher, prepaid card or other means which may be made available by Call2Phone AB. All rights to stop accepting debit or credit cards from one or more issuers have been reserved by Call2Phone AB.
Restrictions. There is not guarantee to use credit balance to purchase all Call2Phone AB products. Certain Call2Phone AB products may have to be paid separately.

Credit expiration:
A credit balance for Call2Phone AB Credit expires 180 days after the last chargeable use of that Call2Phone AB Credit. Credit balances that are not used within this 180 day period will be lost unless otherwise explicity communicated against a specific offer.

Refund policy:
No refunds shall be given for any of the Call2Phone AB services. Once an account is purchased the customer is responsible to use it.
Call2Phone AB reserves the right to deny repetitive refund requests (more than twice for any given type of Call2Phone AB products).
Upon a duly submitted refund request, Call2Phone AB may after necessary investigation refund you the credit balance of your Call2Phone AB Credit only Where you have used less than one unit of prevail currency of your Call2Phone AB Credit, your Call2Phone AB Credit will be refunded in full if your case is deemed just and fair by our relevant staff. However, Call2Phone AB reserves the right to accept or reject any claim/s at any time without the need to disclose any of its findings.
Upon acceptance of a duly submitted refund request, Call2Phone AB will refund you on a pro rata basis for the unused period of subscription of the Call2Phone AB products. All refunds shall be paid either through the original payment method used, or any other reasonable payment method to be determined by Call2Phone AB, and addressed to the person that deposited the credit initially or your Call2Phone AB Credit shall be adjusted accordingly.
Call2Phone AB will not refund any credit balance in the event you terminate your account(s) as permitted under this agreement or in the event that Call2Phone AB terminates this agreement for any reason.
Any abuse by you of the terms relating to refunds hereunder shall lead to the termination of this agreement.

Rates Charged/Payments:
Call2Phone AB shall be paid by user any applicable tariffs as stated on the website or as communicated to your user account in connection with your purchase of respective products/services,. Applicable Tariffs for Call2Phone AB are available at www.Call2Phone.com/rates.html. You will be able to pay/purchase Call2Phone AB credits balance with any suitable payment methods made available by Call2Phone AB through its website or as communicated directly to you.

Tarrif Change:
Call2Phone AB reserves the right change the tariffs at any time without any notice of such change on the website www.Call2Phone.com/rates.html. All tariff changes will be final and you may not ask for a refund of your Call2Phone AB credits. The new tariff will apply to your purchase as soon as the adjustments have been published on the website. You agree that by continuing to purchase Call2Phone AB products following the adjustments of the tariffs, you accept the new tariffs.

Tax:
Call2Phone AB, is registered in Sweden VAT and other applicable Taxes will be charged from Sweden residents as per ongoing laws. Local taxes may apply in certain countries. When you purchase a voucher depending on the country, local VAT or other taxes may apply and may be deducted from the value of the voucher upon redemption.

Limitation of liability:
In the event of Call2Phone AB being in breach of any of its obligations towards you under these Terms of Service, Call2Phone AB will accept liability to pay damages only to the extent laid below:
Call2Phone AB can only be held liable for direct damages resulting from an attributable failure to perform its obligations under these Terms of Service. Direct damages in this respect exclusively mean all reasonable costs incurred by you in order to (i) have Call2Phone AB perform its obligations under the Terms of Service or (ii) to prevent or limit such costs. To the maximum extent permitted by applicable law, Call2Phone AB shall not be liable for any indirect, special, incidental or consequential damages whatsoever (including but not limited to, damages for loss of profits or confidential or other information, for business interruption, for loss of privacy arising out of or in any way related to the use of or inability to use the Call2Phone AB products/services, even if Call2Phone AB has been advised of the possibility of such damages. The direct damages as meant in this article shall be limited to the amount actually paid by you for the Call2Phone AB calling services durin the year in which such damages occur. In no event, however, shall the total compensation for any direct damages exceed 100-Euros.

Specific Disclaimer of Liability for Emergency Services:
Call2Phone AB products do not and are not intended to support or carry emergency calls to any type of hospitals, law enforcement agencies, medical care unit or any type of emergency services of any kind. Neither Call2Phone AB nor its officers or employees may be held liable for any claim, damage, or loss, and you hereby waive, to the maximum extent permitted by applicable law, any and all such claims or causes of action, arising from or relating to the use of Call2Phone AB products or any other service provided hereunder to contact emergency services personnel. You shall defend, indemnify, and hold harmless Call2Phone AB, Call2Phone AB staff, affiliates and agents and any other service provider who furnishes any services to you in connection with the Call2Phone AB products or any other services provided under these Terms of Service, from any and all claims, loss damages, fines, penalties, costs and expenses (including, without limitation, attorneys fees) arising from your failure to inform anyone using your account or control panel that Call2Phone AB does not support emergency calls.

Jurisdiction’s Limitations:
As some jurisdictions do not allow some of the exclusions or limitations as established above, some of these exclusions or limitations may not apply to you. In that event the liability will be limited as far as legally possible under the applicable legislation.

Force Majeure:
You acknowledge and understand that if the Call2Phone AB products/services do not function as a result of a force majeure event Call2Phone AB will not be in breach of any of its obligations towards you under these Terms of Service. A force majeure event means any event beyond the control of Call2Phone AB. In the event Call2Phone AB is affected by a force majeure event, it shall promptly notify you of the estimated extent and duration of its inability to perform or delay in performing its obligations, on a reasonable efforts basis. Call2Phone AB will not accept any liability for the consequences arising out of a force majeure event.

Duration:
The agreement will be effective as of the date of your acceptance thereof or as of the date of your first use of any of Call2Phone AB products, and will remain effective until terminated by either party.

Termination:
You may terminate your agreement with us at any time. Without limiting other remedies, Call2Phone AB or its affiliates may limit, suspend, or terminate your use of Call2Phone AB products and software, prohibit access to Call2Phone AB website, remove hosted content, and take technical and legal steps to keep you off Call2Phone AB website if we think that you are in breach of these Terms of Service, creating problems, possible legal liabilities, acting inconsistently with the letter or spirit of our policies, infringing someone else’s intellectual property rights, engaging in fraudulent, immoral or illegal activities, if you purchased Call2Phone AB credit from an unauthorized reseller, or for other similar reasons, with immediate effect and without recourse to the courts. Call2Phone AB shall effect such termination by preventing your access to your account and to the Call2Phone AB calling services . If you provided a valid email address, Call2Phone AB may provide notice to you by email.
All provisions which must survive in order to give effect to their meaning shall survive any expiration or termination of the agreement, including without limitation, all of your representations, warranties and indemnification obligations.

Update:
Call2Phone AB reserves the right to modify these Terms of Service at any time by publishing the revised Terms of Service on the Website, which shall become effective within thirty (30) days from the date of publication, unless you expressly accept the revised Terms of Service earlier by clicking on the accept button. Your continued use of the Call2Phone AB products after expiry of the 30-day period shall constitute your acceptance to be bound by the terms and conditions of the revised version of the Terms of Service. If you do not wish to accept these revised Terms of Service, you are entitled to terminate your account, in writing or by e-mail to billing@Call2Phone.com, with effect from the date on which the revised Terms of Service would become effective. Miscellaneous

Entire Agreement:
These Terms of Service together with the End User License Agreement constitute the entire agreement between you and Call2Phone AB with respect to the subject matter of this agreement, and will supersede and replace all prior understandings and agreements, in whatever form, regarding the subject matter.

Partial Invalidity:
Should any term or provision hereof be deemed invalid, void or unenforceable, the remainder of these Terms of Service shall nonetheless remain in full force and effect.

No waiver:
If Call2Phone AB does not take action against a breach of these Terms of Service, it does not mean that it waives its right at a later time to enforce the same.

Assignment:
You are not allowed to assign this contract or any rights hereunder. Call2Phone AB is allowed to, at its sole discretion; assign this contract or any rights hereunder to any third party, without giving prior notice. Applicable law and competent Court. The agreement shall be governed by and construed in accordance with the laws of Sweden without giving effect to the conflict of laws or provisions of Sweden or your actual state or country of residence, and without prejudice to the applicable mandatory laws of your country of residence. Any legal proceedings arising out of or relating to agreement will be subject to the jurisdiction of the courts of the Sweden.

Language:
The original English version of this agreement may have been translated into other languages. In the event of inconsistency or discrepancy between the English version and any other language version of this agreement, the English language version shall prevail.

Additional terms for the use of Call2Phone AB:
You agree that Call2Phone AB has no control over the way your cell phone or other phone provider will charge you for outgoing or incoming calls to or from our network. It is entirely upto you to choose the right rate plan from your phone service provider and make sure that you are able to take benefit of Call2Phone AB calling services.
In case of CallBack requests, Call2Phone AB servers will initiate the CallBack using the same local access number that you dialed to request the CallBack. In case you used a Toll Free number, Call2Phone AB is free to choose the number that it will use to initiate the CallBack.
